Sunjay Kapur will dispute: Crucial Delhi HC hearing today amid row over non-disclosure of assets

The Delhi High Court will resume the hearing in the case linked to late industrialist Sunjay Kapur’s Rs 30,000-crore inheritance battle. A day after adjourning the matter, the High Court will resume the hearing regarding the demand by Kapur’s widow Priya Sachdev Kapur for a confidentiality pact and submission of details of personal assets in a sealed cover.

The petition is part of an inheritance war between the children of Sunjay Kapur’s former wife, actor Karisma Kapoor, and Priya Sachdev Kapur. Both children, Kiaan and Samiera, moved the High Court to claim a share in their father’s estate.

Weighing on the NDA demand by Priya Sachdev Kapur, several legal experts have said that this is very unusual.

Talking to Moneycontrol, Akshat Khetan, Founder AU Corporate Advisory & Legal Services, said, “The Delhi High Court’s stand is both principled and necessary. Inheritance disputes touch the core of fairness and justice, and no heir should be forced into the shadows of secrecy. Karisma Kapoor’s children, as natural heirs, have every right to scrutinise the assets and defend their rightful share. Confidentiality clauses like NDAs belong to the world of commerce, not family succession. Transparency is not just a legal necessity here, it is the bedrock of justice.”

Even during the Thursday hearing, the High Court had also remarked that the confidentiality pact demand was ‘problematic.’

Sujit Lahoti, Managing Partner at Sujit Lahoti & Associates, called NDAs “a strict confidentiality contract which makes sense in disputes between large companies over business assets, or in matters of national security. But family inheritance cases are very different. Transparency is the lifeline of justice, because how can heirs claim their rights if they’re kept in the dark?”

Talking about the place of such NDAs in the Indian space, Lahoti further said, “The fact is, there isn’t a single precedent in India where a Will or a deceased person’s assets were disclosed under an NDA in a family dispute. Allowing it now would be a departure as it could stop heirs from questioning disclosures, make the process opaque and bury accountability. Inheritance is about fairness, not secrecy, and that’s why Priya Kapur’s request feels so unusual and frankly, troubling.”
