Bengaluru techie suicide: Atul Subhash earned Rs 84,000 per month, was asked to pay this much to ‘well-earning’ wife for minor son

The tragic death of 34-year-old Atul Subhash in Bengaluru has generated significant online discussion. The case has brought renewed attention to concerns about the potential for misuse of Section 498(A), which deals with dowry harassment. The case has fueled debate across the country regarding situations where men and their families face accusations under this section that are claimed to be unfounded.

Lawyer Dinesh Mishra, who represented Subhash in a family court, reportedly asserted that Atul had provided a truthful account of his experiences with the judicial system. Mishra further stated that neither the court nor the presiding judge was responsible for Atul's death, CNN-News18 reported. According to Mishra, the court order regarding alimony did not contribute to Atul's suicide.

Subhash's body was found hanging at his residence in the Manjunath Layout area, which falls under the Marathahalli police station limits. A placard reading "Justice is due" was found in the room where he ended his life.

The lawyer explained that Atul Subhash's monthly income was around Rs 84,000. The Family Court in Jaunpur ordered him to pay Rs 40,000 per month for his child's support in July. The lawyer clarified that this amount was only for the child and did not include any money for his wife as she was well-established and earned a good income.

“Atul probably thought this Rs 40,000 was too much. If he felt this amount was excessive, he should have gone to the High Court to challenge it,” the lawyer was quoted as saying by CNN-News18.

After paying the alimony, Subhash had Rs 44,000 left each month for himself and his family’s living expenses in Bengaluru. The lawyer stressed that the justice system cannot be held liable for an individual's decision to commit suicide. Such a decision is a personal choice with complex underlying factors.

An FIR has been filed against four people in connection with the suicide. The FIR based on a complaint by Atul's brother Bikas Kumar was lodged at the Marathahalli police station in Bengaluru. The FIR has been filed under section 108 (abetment of suicide) and section 3 (5) (establishes joint criminal liability when two or more people act with a common intention) of the BNS.

The FIR is filed against the techie's wife Nikita Singhania, his mother-in-law Nisha Singhania, his wife's brother Anurag Singhania and his wife's uncle Sushil Singhania.
