The Central Bureau of Investigation (CBI) will file an application before the Calcutta high court within two days seeking the death penalty for convict Sanjay Roy, ANI reported citing CBI sources.

This comes after the West Bengal government on Tuesday moved the Calcutta High Court seeking death penalty of convict Sanjoy Roy in the RG Kar hospital doctor's rape and murder case, challenging the order of the trial court that sentenced him to life imprisonment till death.

The state’s move came in less than 24 hours after Chief Minister Mamata Banerjee expressed her disappointment with the verdict on Monday and announced her intent to challenge the judgment before a higher court.

Advocate General Kishor Datta moved a division bench comprising Justices Debangsu Basak and Md Shabbar Rashidi on Tuesday morning, seeking the court's leave to file the appeal challenging the order passed by Additional District and Sessions Judge in Sealdah, Anirban Das.

On January 20, a Kolkata court sentenced convict Sanjay Roy to life imprisonment until death after finding him guilty of raping and murdering a trainee doctor at RG Kar Medical College and Hospital. Roy was also ordered by the court to pay a fine of Rs 50,000.

Roy was convicted under Section 64 (rape), Section 66 (punishment for causing death), and Section 103 (murder) of the Bharatiya Nyaya Sanhita (BNS).Reacting to the sentencing, West Bengal Chief Minister Mamata Banerjee said, “When someone is a demon… can the society be human? Sometimes they get out after a few years. If someone commits a crime, should we forgive them? If someone commits a crime and gets away, he will do it again. Our job is not to protect them.”
