Singur Act subjecting Tata Motors to hostile discrimination

The legal battle over the Singur land act kicks off. Tata Motors today moved the Calcutta High Court wanting the court to become the custodian of the land and maintain status quo.

The legal battle over the Singur land act kicks off. Tata Motors today moved the Calcutta High Court wanting the court to become the custodian of the land and maintain status quo.


It has filed a petition in this regard saying that the company continues to incur Rs 1 crore expenses per month to maintain Singur. And, the losses at present stand at around Rs 1,400 crore for investment on the ground. "This should be compensated by the state government," the company says.


Moreover, the petition states that there have been no grounds or principles laid down for compensation and the government cannot re-vest the land to original owners as per law.


Talking about the Singur Act, the company said in its petition that it is a colourable piece of legislation and constitutes a fraud of constitution of India. In fact, it violates the rights granted under Article 14, 300 (A).


Tatas say that the act is directed against the company, subjecting them to hostile discrimination. The Re-vesting of land to state government is illegal as well as null and void. Also, the company feels that the return of land to unwilling owners is illegal.
