New bench to hear PIL seeking CBI probe into chit fund scam

The hearing of the PILs seeking a CBI probe into the multi-crore chit fund scam will be heard by a new bench of the Calcutta High Court as the Chief Justice has released the matter from his bench.


The division bench comprising Chief Justice Arun Mishra and Justice Joymalyo Bagchi, which was so long hearing the PILs, would now be heard by a new bench of Justice A K Banerjee and Justice M K Chaudhuri as the Chief Justice would be out of station on Thursday.


The court is going on a summer vacation from Friday. Subrata Mukhopadhyay, counsel for one of the petitioners, moved an oral plea before the division bench comprising Chief Justice Mishra and Justice Bagchi, alleging transfer of property by the Saradha Group despite an order by the bench against any such activity.


When he was told that the bench, which has been hearing the PILs in this regard since last week, would not sit on Thursday, he prayed for transfer of the matter to some other bench claiming that he wanted an early hearing in the matter as it involved the fate of lakhs of investors.


It is likely that the matter would be heard afresh by the new bench presided by Justice Banerjee, said Rabishankar Chatterjee, counsel for petitioner of another PIL with the same prayer, all of which were being heard together. The CBI has, meanwhile, affirmed a seven-page affidavit before the court as per its direction.

The court had directed the CBI to file an affidavit stating which states had assigned it (CBI) to investigate the scam. The scam came into the open after the Saradha Group, which allegedly duped lakhs of investors of thousands of crores of rupees under different investment schemes, went bust in mid-March.
