The intense battle over the Rs 30,000-crore estate of late industrialist Sunjay Kapur has taken a dramatic new twist. Months after Sunjay’s children with former wife Karisma Kapoor moved the Delhi High Court, his minor son with his third wife and widow, Priya Sachdev Kapur, has now challenged the plea filed by Samaira and Kiaan Raj Kapur.
According to a PTI report, the counsel representing the six-year-old argued that the plea by Karisma’s children was based on “speculation and guesswork.”
“This entire case is based on speculation and guesswork. Their case is that on July 30, the executor read out the document hurriedly, slashed a portion, and read it out selectively. At that point, they admittedly knew three things — the date, the witnesses, and that they were excluded,” senior advocate Akhil Sibal, appearing for Priya’s son, submitted before Justice Jyoti Singh, who is hearing the matter.
Previously, Priya Kapur had told the high court that it was a "healthy tradition" for a husband to give all his assets to his wife. She had also refuted the claim of Karisma's children that their father's alleged will had surfaced under suspicious circumstances.
However, there are many who feel that Priya’s defence is not convincing.
“Is Priya Kapur’s legal team joking? I mean just imagine the extent of mockery they are making of Sunjay Kapur, who was heading Rs 30,000 crore worth Sona Group’s businesses. You are saying he was fine with Vikram Chatwal’s biological daughter Safira Chatwal becoming a beneficiary of his estate but not Sunjay’s own biological daughter Samaira; Sunjay and Priya both can’t spell their own son Azarius’ name correctly; the will’s executor Shraddha Suri Marwah, witnesses Nitin Sharma and Dinesh Agarwal, and Sona BLW’s director Priya Kapur, are all highly placed professionals but they are not literate enough to see a Will fraught with silly glaring spelling mistakes and grammatical errors, and collectively agree to keep an industrialist’s will unregistered and un-notarized even after referring to Kapur family’s other wills that are all notarized! Even a law school student wont be using these as legal arguments to methodically mislead a court,” Rahul R Shelke, Civil Lawyer, Bombay High Court told Moneycontrol.
“If one goes by Priya Kapur’s arguments it is increasingly becoming evident that even the counsels are a part of a well-orchestrated campaign to usurp late industrialist Sunjay Kapur’s assets by blatantly misleading the court with these jokes. Justice Jyoti Singh is a highly revered judge and I am sure she can see through the conspicuous loopholes in the Will and the mockery Priya’s counsels are making not only of the law but of the basic intellect of those who happen to be directors of well-regulated companies and industry leaders,” Shelke added.
