Who can you nominate?

Family members: As per the Payment of Gratuity Act, 1972, an employee can nominate one or more members of their family to receive the gratuity in case of an untimely death. Family members include:

  • Parents (in the absence of spouse or children)
  • Siblings or extended family in some cases, if applicable

Who cannot be nominated?

There are also restrictions when it comes to gratuity nominations. Here’s who you cannot nominate:

Non-family members: If you have a family at the time of making the nomination, you are not allowed to nominate someone outside your family, like friends or unrelated individuals. The gratuity must go to a family member.

Minors without a guardian: If you wish to nominate a minor child, you will also need to appoint a guardian to manage the gratuity until the minor comes of age. Without a guardian, the nomination won’t be valid.

How to submit your gratuity nomination

Making sure your gratuity nomination is submitted correctly can save your family from legal and financial challenges. Here's how to do it:

Fill out Form F: To nominate someone, employees need to submit Form F (Nomination Form) to their employer. This form is provided under the Payment of Gratuity Act, 1972.

Details required: The form will ask for details such as:

  • Employee's name and address
  • Name and address of the nominee(s)
  • Relationship of the nominee to the employee
  • Share of gratuity each nominee is entitled to
  • Signatures of the employee and a witness
Submission: Once the form is duly filled out, it should be submitted to the HR department or the concerned authority in your organization. Some organizations may accept digital submissions or have online portals for this.

Review and update regularly: Life changes such as marriage, the birth of a child, or the passing of a family member should prompt you to update your nomination. You can revise your nomination at any time by submitting a new Form F to your employer.
