The Delhi High Court on April 22 rejected a Public Interest Litigation (PIL) asking the court to grant "extraordinary interim bail" for Delhi chief minister Arvind Kejriwal on the ground that his safety is in danger as he is confined with hardcore criminals.
The HC noted that the law is above every person in the country and imposed a fine of Rs 75,000.
The HC said, "He (Kejriwal) is in custody by judicial order. The matter is pending in Supreme Court. Who are we to advise him? Who are you? You have some exaggerated opinion of yourself."
The court asked the petitioner, a law student, if he attends college and has good attendance. The court also took note of the fact that the petitioner belongs to a registered political party.
The court said, "We have said at times personal interest has to be subordinate to national interest. But that is the Chief Minister's personal call. We are no one to advise him."
'Plea filed for publicity'"Whatever needs to be done, I will do it" said Kejriwal's lawyer Rajeev Mehra, when the plea came up for hearing. Mehra argued that this plea was field purely for publicity and urged the court to dismiss it. He said, "A fourth year law student has filed this based on bad advice. This is a sad state of affairs." Mehra further argued that three such pleas have already been dismissed and the lawyer who filed this PIL should have read this before filing such a plea.
The petitioner, a law student, mentioned his name as "We, the people of India" in the plea, claiming that he does not want any name, fame, or money from this matter. The PIL claimed that the safety and security of Kejriwal is in danger because he is confined with hardcore criminals, who are facing prosecution in cases such as rape, murder, dacoity, and bomb blasts.
Several inmates including gangsters like Prince Teotia and Tillu Tajpuria were killed in custody despite security given by the jail authorities, the PIL alleged.
The petitioner incredibly stated that he has decided to grant extraordinary interim bail to the Delhi CM by using his 'veto power' until the end of Kejriwal's tenure and completion of trial of the cases against him, lodged by the ED and CBI.
