The United States Embassy in India has issued a fresh advisory for Indian travellers holding or applying for B1 and B2 visitor visas, urging them to clearly understand what activities are permitted—and what are strictly prohibited—before travelling to the US.

Released on January 8, 2026, the advisory highlights that misuse of a visitor visa or overstaying the authorised period could have serious long-term consequences, including a permanent ban on future travel to the United States.

What this US visa advisory means for Indian B1, B2 visa holders

The warning was delivered through an animated video shared on X, where the embassy stressed that compliance with visa rules begins even before a traveller boards a flight.

“During your visa interview, if the consular officer believes you do not intend to follow the rules for a visitor visa, he or she may deny your application,” the embassy stated in the video.

The embassy further reminded applicants that the responsibility of using the visa correctly lies entirely with the visa holder.

In the same video message, the US Embassy made its stance unambiguous: “Learn what you are and are not allowed to do when visiting the United States on a B1/B2 visitor visa. If you misuse your visa or stay longer than allowed, you could be permanently banned from future travel,” the embassy further stated through the video.

Applicants were also directed to official resources for accurate and up-to-date information, with the embassy advising travellers to “learn more at travel.state.gov/visas”.

Why this advisory matters

The advisory underscores that visitor visas are not flexible permits and are issued for specific, limited purposes. Any deviation—whether intentional or accidental—can trigger visa denial, cancellation, or future ineligibility.

The embassy emphasised that travellers should familiarise themselves with permitted activities under their visa category before finalising travel plans, especially as increased scrutiny continues at visa interviews and ports of entry.

What activities are permitted on a B1 visa?

According to the US Department of State, holders of a Business (B1) visitor visa may engage in the following activities:

  • Consult with business associates.
  • Attend a scientific, educational, professional, or business convention or conference.
  • Settle an estate.
  • Negotiate a contract.

However, the consulate clarified that employment of any kind is not permitted under a B1 visa.

What activities are allowed on a B2 tourist visa?

Examples of activities permitted under a B2 (Tourism) visa include:

  • Tourism.
  • Vacation (holiday).
  • Visit with friends or relatives.
  • Medical treatment.
  • Participation in social events hosted by fraternal, social, or service organisations.
  • Participation by amateurs in musical, sports, or similar events or contests, if not being paid for participating.
  • Enrolment in a short recreational course of study, not for credit toward a degree (for example, a two-day cooking class while on vacation).

Authorities reiterated that while sightseeing and leisure activities are allowed, working, paid performances, or enrolling in long-term academic courses are strictly prohibited.

No work allowed under B1/B2 visas

The embassy clarified that although B1 and B2 visa holders may attend meetings, conferences, or negotiate contracts, these visas do not permit employment or income-generating activities.

Travellers were advised to ensure they apply for the appropriate visa category based on their intended activities to avoid violations that could jeopardise future travel.

Part of a series of recent US visa warnings

This advisory follows a string of recent warnings from the US Embassy in India. On January 7, 2026, the embassy cautioned international students that violating US laws could result in deportation and visa cancellation.

“Breaking US laws can have serious consequences for your student visa. If you are arrested or violate any laws, your visa may be revoked, you may be deported, and you could be ineligible for future US visas,” the US Embassy said in a post on X.

It further emphasised that “the US visa is a privilege, not a right.”

Last week, the embassy also issued a warning for H-1B and H-4 work visa applicants, stating that violations of US immigration laws could result in significant criminal penalties.

What are B1 and B2 visas?

B1 and B2 visas are temporary US visitor visas issued to foreign nationals for short-term stays.

B1 visas are meant for limited business-related activities such as meetings, conferences, estate matters, or contract negotiations.

B2 visas are designed for tourism, leisure, family visits, medical treatment, and select unpaid recreational activities.

Both visa types come with strict conditions, and authorities have repeatedly stressed that misuse can lead to long-term consequences.
