Chidambaram-INX Media case highlights: Ex-FM to be kept in CBI custody till September 2

The Supreme Court of India (SC) is expected to hear former union finance minister P Chidambaram's pleas challenging the Delhi High Court's order which denied him anticipatory bail in the INX Media money-laundering and corruption cases, today (August 26).

A bench headed by Justice R Banumathi is also scheduled to hear a fresh plea by Chidambaram in which the former union minister has challenged the arrest warrant issued against him and the trial court's order remanding him to Central Bureau of Investigation (CBI)’s custody till today in the INX Media case.

On August 23, the apex court had granted protection from arrest till today to Chidambaram in the case lodged by the Enforcement Directorate (ED).

The court has sought replies from ED on Chidambaram's plea and directed that all the three matters should be listed today.

Solicitor General Tushar Mehta, appearing for ED, had said that lot of "hue and cry" and "political vendetta" is alleged by the petitioner (Chidambaram) and his party colleagues but "I am saying with a great sense of responsibility that this is a case of money laundering of a monumental magnitude".

    The order was passed by Special Judge Ajay Kumar Kuhar before whom Chidambaram was produced on expiry of four-day custodial interrogation granted on August 26.
    "Investigation being the prerogative of the investigating officer and given the fact that the record is voluminous and accused needs to be confronted. Thus, more time is required. In view of the submissions made, the accused is sent to police custody remand till September 2," the judge said while pronouncing the order. (PTI)

    Money laundering offence against nation, need Chidambaram's custody to unearth conspiracy: ED to SC

    Money laundering is an offence against "society and nation", the ED told the Supreme Court Thursday and said it needed custodial interrogation of former finance minister P Chidambaram to unearth the larger conspiracy in the INX Media money case under PMLA.

    The Enforcement Directorate told a bench of Justices R Banumathi and A S Bopanna that it cannot show the material collected during the probe to Chidambaram at this stage as the evidence related to money trail of layers of money might be erased.

    Solicitor General has cited judgments of CrPC Section 172 to persuade the bench to look at the case diary, as aid in the case. SG Tushar Mehta has said that showing the diary to the accused could prejudice the probe and could influence witnesses.

    As a matter of practice, courts look into case diaries to satisfy their judicial conscience, the Solicitor General has told SC, according to Live Law.
