LML parent firm files lawsuit against Bajaj Auto for unauthorized use of ‘Freedom’ trademark

SG Corporate Mobility Pvt Ltd, the parent company of LML, said on October 3 that it has filed a lawsuit in the Delhi High Court against Bajaj Auto Ltd, alleging unauthorized use of the trademark ‘Freedom’ in Bajaj’s recently launched Freedom CNG motorbikes.

The lawsuit asserted that Bajaj Auto’s use of the ‘Freedom’ name for its CNG motorbikes infringes on SG Corporate Mobility’s statutory trademark rights and diminishes the well-established reputation of the LML 'Freedom' brand.

The lawsuit also underscored SG Corporate Mobility’s determination to safeguard its intellectual property rights and protect the legacy of the iconic ‘Freedom’ brand.

In its press release, SG Corporate Mobility emphasized the historical importance of the ‘Freedom’ brand, stating that the trademark first gained prominence in 2002 with the launch of the LML Freedom motorbike by LML Ltd.

The company noted, “In 2002, LML Ltd. launched its motorbikes bearing the trademark ‘FREEDOM’ which was a massive success in the Indian market and still carries an immense goodwill and reputation in the minds of the public at large which is solely associated with LML Ltd. The iconic trademark ‘FREEDOM’ along with the trademark ‘LML’ were assigned to SG Corporate Mobility Pvt. Ltd. in 2021 by LML Ltd. along with goodwill and reputation associated with the mark ‘FREEDOM’.”

The company explained that since acquiring the rights to the ‘Freedom’ and ‘LML’ trademarks in 2021, it has been working to preserve the legacy of these iconic names while planning new launches under the 'Freedom' label. The current lawsuit filed in the Delhi High Court, it said, is part of SG Corporate Mobility’s ongoing effort to protect its intellectual property rights and the goodwill associated with the Freedom brand.

SG Corporate Mobility expressed its ambitious plans to introduce a new range of scooters and motorbikes under the renowned "Freedom" label, alongside the "LML" brand, as part of their strategy to revive these iconic names.

The case is currently pending before the court.
