
The legal battle over the estate of industrialist Sunjay Kapur has taken a serious turn, with his children Samaira Kapur and Kiaan Kapur, from his marriage with actor Karisma Kapoor, now seeking criminal action against his second wife Priya Sachdeva.
According to sources, the siblings have approached the Delhi High Court requesting that Sections 338 and 340 of the Bharatiya Nyaya Samhita be invoked against Priya Sachdeva.
They have alleged that the will produced by her, which excludes them from their father’s inheritance, is fabricated. If the court agrees to invoke these provisions, the matter could move beyond a civil partition dispute and take the shape of a criminal case. Conviction under these sections could carry severe punishment, including life imprisonment.
In their submissions, Samaira and Kiaan have challenged the circumstances under which the will was allegedly executed.
They claim that on March 21, the day the Will is said to have been signed, neither Sunjay Kapur nor Priya was present in Gurgaon, where the execution is claimed to have taken place. Instead, they argue both were in Delhi.
They also stated that their mother Karisma Kapoor was in contact with Sunjay Kapur via WhatsApp on that day regarding discussions about Portuguese citizenship for the children.
Priya, in her submissions, has maintained that the will was first drafted on February 10, 2025, modified on March 17, and finally executed on March 21 at the Gurgaon office of AIPL, in the presence of two attesting witnesses, Dinesh Aggarwal and Nitin Sharma.
However, sources told NDTV that the statements of these witnesses do not clearly confirm that the will was executed in Gurgaon. The siblings have argued that this omission strengthens their claim that the will was not signed at the stated location and is therefore a forgery. They have also asked the court to seize the mobile phones of Priya Kapur, Sunjay Kapur, and the two witnesses, alleging that a fake digital trail was created to support the will.
Pointing to inconsistencies, the siblings noted that there is no clear digital footprint of Sunjay Kapur himself in the documents presented.
They also questioned how the will could have been modified on March 17 when Sunjay Kapur was reportedly travelling with Kiaan in Goa and later returned to Delhi to visit his injured mother.
Further doubts have been raised over the role of the executor, Shraddha Suri Marwah, who allegedly sought clarity months later on who drafted the will. The siblings have also highlighted spelling and grammatical errors in the document, arguing that such mistakes would be unlikely from their father.
The matter is now scheduled to be heard on January 20 before Judicial Magistrate Gagandeep Singh, as the dispute continues to deepen.
