
The Delhi High Court has stepped in to protect Vivek Oberoi’s personality rights, ordering quick action against the alleged misuse of his name, image, likeness and voice across various online and offline platforms.
The case was argued for Vivek Oberoi by advocate Sana Raees Khan and her team. In a significant move, the Court also granted a dynamic injunction and a John Doe order — measures designed to not only address the parties currently named in the suit, but also cover unknown or future offenders who may try to exploit Vivek Anand Oberoi’s identity in similar ways.
The matter, listed as CS(COMM) 105/2026, came up before Hon’ble Mr. Justice Tushar Rao Gedela on 5 February 2026. As recorded in the order, Vivek Oberoi approached the Court alleging that key parts of his persona — including his name, voice and likeness — were being misappropriated in a manner that the public would naturally associate with him.
The Court also took note of how Vivek Anand Oberoi has built goodwill over the years, not only as an actor with a career spanning more than two decades, but also as an entrepreneur and philanthropist.
That context mattered, because the suit is not simply about celebrity or branding — it is about control over one’s identity, and how easily that identity can be weaponised or monetised without consent.
In the pleadings referred to by the Court, Vivek Anand Oberoi asserts that the commercial use of his distinctive attributes is his alone to permit — including “(a) name ‘Vivek Oberoi’; (b) voice; (c) image and likeness”. The Court, after reviewing the material on record, found that Vivek Anand Oberoi had made out a prima facie case, and observed that the balance of convenience lay in his favour. It also acknowledged that the harm caused by such misuse cannot always be undone or compensated later.
As a result, the Court restrained the defendants, including unidentified John Does, from using or exploiting Vivek Anand Oberoi’s persona for any personal or commercial gain — including through tools such as “Artificial Intelligence, Generative Artificial Intelligence, Machine Learning, Deepfakes, Face Morphing”.
The order also directed certain defendants and intermediaries to take down the listed infringing links within 72 hours, and to share identifying details such as login and IP information within the timelines set by the Court.
Beyond the legal language, the case frames the alleged misuse as something deeply personal — the kind of violation that does not just impact reputation, but also affects family life and peace of mind.
