Delhi HC restrains Deepika Padukone’s brand 82 E from using ‘Lotus Splash’ mark

Deepika Padukone’s brand 82°E has been restrained by the Delhi High Court from using the ‘Lotus Splash’ mark after a trademark suit by Lotus Herbals. The court granted an interim injunction, citing prima facie similarity between the two brands’ marks.

Deepika Padukone and her company, DPKA Universal Consumer Ventures has recently landed in a legal fight over trademark infringement after Lotus Herbals filed a lawsuit against the actress’ brand. Lotus Herbals accused her company of claiming that the 'Lotus Splash' is similar to their 'Lotus' mark.

The Delhi High Court issued an interim injunction on Monday prohibiting Deepika's company, DPKA Universal Consumer Ventures, from using the mark "Lotus Splash" for its facewash/face cleanser product, according to the most recent report from Bar and Bench. Lotus Splash is a face cleanser sold by Deepika's self-care company 82°E.

The Lotus Splash mark was found to be similar to the lotus mark of Lotus Herbals Private Limited, another firm that sells cosmetics and beauty items, according to a Division Bench consisting of Justices V Kameswar Rao and Vinod Kumar. The bench overturned a January 25, 2024, single-judge ruling that had denied the actor an injunction.

According to Hindustan Times, the judge said in an official statement, “We allow the application [for interim injunction]. We do not agree with the respondent’s [DPKA] case falling under the exception as discussed by the single-judge. We allow the application under Order 39, Rules 1 and 2. We have granted the interim injunction, we have held that there is a prima facie case."

According to Section 30(2)(a) of the Trade Marks Act, which stipulates that using a trademark to identify the type, quality, quantity, intended use, value, place of origin, time of production of goods or time of rendering of services, or other attributes of the goods or services is not trademark infringement, it was decided that the Lotus Splash mark was protected.

In 2022, Deepika launched 82°E, her own line of self-care products. The brand's name, which is pronounced "eighty-two east," is based on the meridian that establishes India's standard time and runs longitudinally through the country.

Deepika's entry into the world of full-fledged entrepreneurship is also marked by the launch of 82°E. The actor, producer, and mental health advocate, who established her non-profit organisation, The Live Love Laugh Foundation, a few years ago, claims that she wants to promote a comprehensive approach to self-care by utilising science to create expertly designed, clinically tested products for glowing, healthy skin.

On the film front, Deepika is gearing up for the highly anticipated film, King, co-starring Shah Rukh Khan and Abhishek Bachchan. King will be released in Christmas 2026.
