Kanpur Lamborghini case takes new turn: Injured man doesn't want legal action, claims driver ‘not Shivam Mishra’

The defence lawyer argued that since the injured person has accepted compensation and named the driver, the matter should be viewed as an issue between the driver and the victim.

A fresh twist has emerged in the Kanpur Lamborghini crash case after Shivam Mishra’s lawyer, Narendra Kumar Yadav claimed that the permanent driver of the luxury car has taken full responsibility for the accident.

According to Yadav, the driver, Mohan (45) has submitted an affidavit stating that he, and not Shivam Mishra, was behind the wheel when the Lamborghini rammed into pedestrians and vehicles, injuring a man on Sunday evening.

Yadav said the driver has clearly admitted his role. “In this case, the accused has given an affidavit stating that I am the permanent driver of that vehicle and I committed this incident on the day of the incident,” Yadav was quoted by ANI as saying.

'Injured has taken compensation and settled'

The lawyer further claimed that the injured person in the case has already reached a settlement and received compensation. According to him, the injured man has also stated in writing that he does not want any further legal action.

“The injured and the plaintiff reached a settlement and received all the compensation. After receiving it, he has written that he does not want any action in this case,” Yadav said.

“Now that he has received compensation, who can make a better plea than him? He himself has identified the driver,” the lawyer added.

He argued that since the injured person has accepted compensation and named the driver, the matter should be viewed as an issue between the driver and the victim.

Driver claims seizure led to crash

According to Mohan, Shivam Mishra was seated beside him when the incident took place. He claimed that Shivam suddenly suffered a seizure moments before the crash, causing him to lose control of the vehicle.

“I was driving the car when the accident happened. Suddenly, he had a seizure and fell on me. I got scared and tried to hold him with one hand. During this, the car hit a three-wheeler, climbed the divider and then stopped,” Mohan told reporters.

Court rejects surrender plea

However, a Kanpur district court rejected Mohan’s application seeking to surrender and be taken into judicial custody. Prosecuting Officer Nagendra Kumar Mishra said the court considered two applications on Wednesday.

The first application was filed by Mohan, seeking to surrender in connection with the accident case. The second application sought the release of the seized Lamborghini.

The court refused to take Mohan into custody, noting that the police had stated he was neither wanted in the case nor named during the investigation so far. Police informed the court that their probe showed Shivam Mishra was driving the vehicle at the time of the crash.

Police investigation still on

Despite the lawyer’s claims, the police have maintained that their investigation is still ongoing. The lawyer acknowledged this, saying the police should continue their probe and that the final decision rests with the court.

“The police is conducting its own investigation. Let it continue. The court’s order is awaited,” Yadav said.

He also pointed out that the incident occurred suddenly and that police were not present at the scene at that moment. “This incident happened between the driver and the injured. Who can have a better understanding than the injured?” he asked.

Police earlier named Shivam Mishra as driver

The latest claims come amid a continuing dispute over who was driving the Lamborghini at the time of the crash. Earlier, police officials had said that Shivam Mishra, son of tobacco businessman K K Mishra, was driving the luxury car.

Deputy Commissioner of Police (Central) Atul Kumar Srivastava had earlier stated that the driver mentioned by the defence did not figure in the police probe and that evidence pointed to Shivam being behind the wheel. Police had also said that a technical examination of the Lamborghini was still pending.
