CBI will take a call on opposing the bail applications of the accused in the telecom spectrum allocation scam only after framing of charges which is likely to take place on September 15.
Sources in the agency said although there is "no material evidence" to prove money trail in the case of Unitech but they have not been absolved of criminal conspiracy.
When asked whether the CBI will oppose the bail plea of Sanjay Chandra, MD of Unitech, they said a decision on the issue would be taken only after September 15, when charges are framed in the trial court.
Former Telecom Minister A Raja, DMK MP Kanimozhi, former telecom secretary Siddharth Behura, Raja's PS RK Chandolia, Reliance Infocomm executives Surendra Pipara, Hari Nair and Gautam Doshi, DB Realty's managing director Vivek Goenka, Kalaignar TV MD Sharad Kumar and Swan telecom Promoter Shahid Usman Balwa are some of the accused arrested in the 2G spectrum allocation scam who are in jail.
A Delhi court will decide on September 15 whether to put 17 accused on trial for their alleged role in the 2G spectrum allocation scam, which according to CBI has said caused a loss of Rs 30,984 crore to the public exchequer.
While concluding his argument, CBI had told the court that Swan Telecom and Unitech got the licences despite their complete ineligibility to get the same.
The CBI counsel however clarified that there is no evidence or material available on record to indicate that there was any quid pro quo by Unitech (Tamil Nadu) Wireless vis-a-vis anybody or party.
Sources in the agency said there may not be money trail but there is evidence of criminal conspiracy.
