The Supreme Court has passed an interim order directing real estate developer Mantri Castles Private Ltd (also known as Mantri Developers) to hand over possession of the Mantri Serenity project to homebuyers in Bengaluru.
"The homebuyers have still not been given possession despite having paid either the full 100 percent or a little less than 100 percent of the agreement amount. The court directs that strictly in terms of the agreement between the parties, the concerned flat/property/premises would be handed over to the concerned appellants within one week," the order dated November 7 said.
The exercise should be completed before the next hearing, it added. The next date of hearing is posted as February 14.
The case, which includes 48 homebuyers, is being argued by senior advocate Bishwajit Bhattacharyya and is being instructed by advocate Chandrachur Bhattacharyya.
Mantri Castles Private Ltd is now known as Castles Vista Pvt Ltd.
Tortuous journey for homebuyers
When the developer did not deliver their homes by the promised date, the buyers moved the National Consumer Disputes Redressal Commission (NCDRC). However, the NCDRC disposed of the case, following which 48 buyers, who booked flats in 2013 onwards for Rs 75-95 lakh, appealed before the Supreme Court.
The homebuyers who brought the case do not wish to be named as it remains sub judice.
It is alleged that while the developer has since delivered flats to others, it has not done so in the case of these 48 families.
Moneycontrol has confirmed that at the time of writing this report, the homebuyers are still awaiting communication from the developer for possession.
A list of questions has been sent to the developer and the copy will be updated after receiving a response.
