
The Delhi High Court on Thursday issued summons to Priya Kapur, wife of late industrialist Sunjay Kapur, and other family members in a civil lawsuit filed by his 80-year-old mother, Rani Kapur. The plea seeks directions to declare the “RK Family Trust” null and void, alleging it was created through fraudulent means.
Justice Mini Pushkarna asked Priya Kapur and the other defendants, including Sunjay Kapur’s children from his second marriage with actor Karisma Kapoor, to file their written statements in response to the suit. The court also issued notice on Rani Kapur’s application seeking interim relief in the matter.
However, the judge declined to grant immediate status quo orders over the estate at this stage. Justice Pushkarna observed that she would first hear the responses of all parties before passing any directions. The matter has now been listed for further hearing on March 23.
In her detailed lawsuit, Rani Kapur has challenged the validity of the RK Family Trust, which was reportedly constituted in October 2017 in her name. She has alleged that the trust documents are “forged, fabricated and fraudulent” and that she was never informed about the transfer of her assets into the trust.
Rani Kapur stated that she is the sole beneficiary of the entire estate of her late husband, Surinder Kapur, a prominent industrialist and the promoter of the Sona Group of Companies. According to her plea, a “systematic fraud” was carried out to divert these assets into the RK Family Trust without her knowledge or consent.
The suit further claims that till his death, Sunjay Kapur never confirmed to her that she had been divested of her rights, assets and legacy. He also allegedly never provided her with a copy of the purported trust deed. Rani Kapur has accused Priya Kapur and other defendants of acting in collusion with her late son to carry out a complex series of illegal transactions.
“By means of a complex web of illegal transactions undertaken by the defendants in collusion with my now deceased son, all my assets were vested in a fraudulent trust titled the RK Family Trust, without my knowledge,” the plea stated.
Rani Kapur has sought a permanent injunction restraining Priya Kapur, her grandchildren and other family members from using or acting in furtherance of the RK Family Trust in any manner.
Sunjay Kapur passed away on June 12 after collapsing during a polo match in England. He reportedly suffered a sudden cardiac arrest.
Separately, a plea filed by Sunjay Kapur’s two children with Karisma Kapoor, challenging the authenticity of his alleged will, is also pending before the Delhi High Court. The children have accused Priya Kapur of acting out of greed, further intensifying the ongoing family legal battle.
