An FIR has been filed against Mahindra Group chairperson Anand Mahindra and 12 others in Uttar Pradesh for “false assurances” on the safety of cars. The case was registered after a man who lost his son to a car accident filed a complaint, News 18 reported.
Kanpur's Rajesh Mishra claimed that he bought a black Scorpio worth Rs 17.40 lakh after being convinced of its safety features promoted by advertisements and social media posts by Anand Mahindra. He gifted the car to his only son Apoorv Mishra but when he met with a car accident, the airbags supposed to be installed in the car did not deploy, allegedly leading to the son's death.
“On January 14, 2022, my son Dr Apoorv was returning to Kanpur from Lucknow in the car. Along with Apoorv, his friends were also in the car and all of them were wearing their seat belts (mentioned in the police report). Because of fog, the car hit the divider and then toppled several times and my son died on the spot,” the complaint said as per the News18 report.
Mishra added that if the Mahindra company and dealership had not glorified the vehicle's safety features in advertisements, he would have never bought the car.
In his complaint, Mishra said that despite the seat belt being worn, the airbags in the car did not open on impact and that the company had cheated him by giving false assurances. Mishra also claimed that he eventually found through sources that there were no airbags in the car.
He then moved a local court following which an FIR was registered under various sections of the IPC including cheating, negligent conduct with respect to machinery, causing death by negligence, intentional insult with intent to provoke breach of the peace, and criminal intimidation.
