The discharge order, which was issued a day after Shashi Tharoor was cleared of all the charges, said there is no case made out against the accused under Section 306 of Indian Penal Code (IPC), which relates to abetment to suicide.

Additional Chief Metropolitan Magistrate Samar Vishal sent the court to the case to Additional Sessions Judge Arun Bhardwaj since the offence under Section 306 (abetment of suicide) of the Indian Penal Code was triable by a sessions judge.
The documents were filed by police along with the charge sheet. The court also granted Tharoor exemption from personal appearance for the day after an application was moved by his counsel in this regard.
During the hearing, BJP leader Subramanian Swamy requested Additional Chief Metropolitan Magistrate Samar Vishal that he be allowed to assist the police in the case.
Justice R K Gauba asked the Delhi Police standing counsel (criminal) Rahul Mehra to appear in the matter and listed the plea on September 25.

The initial autopsy report, conducted by AIIMS, said it to be ‘unnatural sudden death‘. Though the report said there were no traces of posion in Sunanda's blood, injury marks were discovered on her body. The full autopsy details are expected in two days, said AIIMS.
