Chief Justice of India (CJI) DY Chandrachud has condemned a recent practice where multiple lawyers present the same case to the bench in an attempt to secure a hearing date. He said that lawyers “cannot take the court for a ride” by adopting such tactics.
"This is a new practice. Different counsel mention same case for listing and once a judge blinks, you get some date. This is the practice which is emerging," DY Chandrachud was quoted as saying by Bar and Bench.
The Chief Justice addressed the issue in open court, emphasising that he would not use his discretionary powers as the CJI to accommodate such tactics.
“A little bit of discretion which I have as the CJI will never be exercised in your favour. You cannot take the Court for a ride. My personal credibility is at stake. I have to follow standard rules for all,” he was quoted.
The CJI has pulled up lawyers in many of the recent hearings for mentioning matters out of turn. He has repeatedly instructed lawyers to adhere to proper procedures when seeking hearing dates.
He has also often reprimanded lawyers for interfering in matters and speaking to the bench loudly.
On Monday, the CJI pulled up a lawyer over his casual response to a query while addressing the bench and said that the courtroom is "not a coffee shop".
He asked the lawyer not to use the word "yeah" in court.
"This is not a coffee shop! What is this yeah yeah. I am very allergic to this yeah yeah. This cannot be allowed," he said.
