The Delhi High Court on Thursday termed the NDA demand by late industrialist Sunjay Kapur's widow, Priya Sachdev Kapur, as 'problematic.'
The court made the remarks during the hearing in the inheritance case between Priya and Sunjay Kapur's children from actor Karisma Kapoor.
While hearing Priya's plea, Justice Jyoti Singh said, "It (the non-disclosure agreement) may be problematic for the simple reason that as the alleged beneficiaries of the estate, they (Karisma Kapoor's children) have a right to question the assets disclosed... So, tomorrow, if they have to verify and go about asking what has happened, if they are bound with this confidentiality club, how will they ever defend their case?" the Court asked.
As per reports by Bar and Bench, Justice Singh asked why the NDA was so critical to this case. To this, senior advocate Sheyl Trehan, appearing for Priya Sachdev Kapur, said that the NDA would help in keeping the matter within the courtrooms as everything was getting leaked.
"There has been a lot of media attention. Pleadings have been leaking. After hearings are over, there are press conferences being held at the gate outside. What is happening over here is a situation where everything is being leaked... it is a question of cyber security," Trehan told the court.
Listing some of the details that Priya wants to submit in sealed covers, Trehan said that it includes bank accounts, DMAT, and other critical personal documents. As per a Live Law report, the plaintiff's counsel said that as per their information, "banks have been wiped off, there is nothing left in the bank account."
The application has been filed in a lawsuit moved by Karisma Kapoor's children, Samaira Kapur and Kiaan Raj Kapur, against their father Sunjay Kapur's second wife, Priya Kapur, and their son, as well as the deceased's mother, Rani Kapur, and Shradha Suri Marwah - purported executor of the industrialist's Will dated March 21, 2025.
Additionally, Sunjay's mother, Rani Kapur, has also sought a copy of the Will. Both these matters will be taken up by the court tomorrow at 2:30 pm.
