
The clash between BJP and leader of Opposition in Lok Sabha Rahul Gandhi has now shifted from political sparring to parliamentary procedure. BJP MP Nishikant Dubey has filed a notice for a substantive motion against the Congress leader -- a move being seen as a serious escalation.
Dubey has sought Gandhi’s immediate removal from the Lok Sabha and that he be debarred from contesting elections for life, accusing him of colluding with “anti-India elements”.
What is substantive motion?
A substantive motion is an independent resolution placed before the Lok Sabha seeking a definitive and binding decision from the House. It stands on its own and is not connected to any other item of business. If adopted, it represents the official position of the House on the matter concerned.
Under the House rules, the Speaker’s consent is mandatory for admitting such a motion. The Speaker exercises full authority in deciding whether to allow it and how it should proceed. Upon admission, the motion can be discussed, voted upon, or even referred to a specially appointed committee for further examination.
Unlike routine parliamentary exchanges, a substantive motion obliges the House to formally address the issue and adopt a position, Given Rahul Gandhi’s position as leader of the opposition, any proposed action against him must follow an established parliamentary route, which a substantive motion ensures.
Why substantive motion has been moved against Rahul Gandhi?
Dubey on Thursday said he has given a notice to initiate a 'substantive motion' against leader of the opposition. Speaking to PTI videos, he said that in his notice he has stated how Gandhi visits foreign countries, joining hands with the Soros Foundation, United States Agency for International Development (USAID), Ford Foundation and "colludes" with anti-India elements.
“I have given a substantive motion notice where in I have mentioned how he visits Thailand, Vietnam, Cambodia with Soros Foundation, Ford Foundation and USAID, and colludes with anti-India forces,” he alleged.
Substantive motions are rarely used in everyday political disagreements, and their invocation signals a clear escalation from political rhetoric to formal procedure. If admitted, the Lok Sabha would have to debate the issue and arrive at a formal decision.
For now, the matter rests with Speaker Om Birla, who can choose to admit the motion, reject it, or take any other step permitted under the rules.
