H-1B workers stranded in India as visa scrutiny delays return to US: Report

Indian professionals holding H-1B visas who have returned home for renewals are facing prolonged delays in visa stamping, leaving many stranded in India and exposed to risks such as job losses, pay cuts and potential local tax liabilities, a report by the Economic Times said on January 15.

Several Indians employed in the US on H-1B permits are unable to travel back after coming to India for visa renewals, as processing timelines have stretched following stricter scrutiny of applicants’ social media activity under the Trump administration, according to the newspaper. Immigration experts told ET that interview dates are now being scheduled for March, April or even later, putting employment at risk—particularly for those working with smaller firms and startups.

A further complication relates to taxation. Experts warned that individuals remaining in India for extended periods could become liable to Indian income tax, either as non-residents or tax residents, depending on the duration of their stay, the report said.

According to firms cited by ET, many US companies with employees unable to return are consulting immigration specialists, lawyers and advisory firms to navigate compliance and tax-related challenges arising from the delays.
