Can wife access husband’s salary slip through RTI?

If matrimonial or maintenance proceedings are pending, courts can permit disclosure since the wife needs income details to pursue her rightful claim, say experts

The Rajasthan High Court has upheld the state government’s decision to reject a wife’s Right to Information (RTI) application seeking details of her husband’s salary from the department he was employed in. The information related to an employee’s service record or performance constitutes "personal information" and is protected from disclosure under the RTI Act, the court said.

The court held that salary information pertains to a third party and is exempt from disclosure unless there is an overriding public interest.

“The Court relied on the Supreme Court’s decision in Girish Ramchandra Deshpande v. CIC and reaffirmed that service and employment details are primarily matters between employer and employee. However, the position changes when matrimonial or maintenance proceedings are pending. Courts have consistently held that income details are essential to determine maintenance,” said Anadi Mishra, an advocate who practices in the Delhi High Court.

What is the case?

The case involves a dispute between a wife and her husband regarding the disclosure of salary details under the RTI Act.

Kanta Kumawat filed an RTI application seeking copies of the pay slips and salary details of her husband, Omprakash Kumawat, an employee of the police department, for the January-March 2024 period. The authorities denied the information, saying salary details constituted "personal information" of a third party and are exempt from disclosure under the RTI Act.

In October 2024, Kanta Kumawat challenged the order in the High Court, seeking directions to provide the information. The court held that salary and service-related details of an employee were personal and primarily a matter between the employee and employer.

Relying on a Supreme Court judgment, the court said such information cannot be disclosed unless there is an overriding public interest. Since no such public interest was established, the writ petition was dismissed.

What are the circumstances under which a woman can ask for her husband’s salary slip?

A woman can seek her husband’s salary slip through RTI only under specific conditions.

“Generally, salary details are treated as personal information under Section 8(1)(j) of the RTI Act and exempt from disclosure unless public interest justifies it. However, courts allow access when matrimonial proceedings for maintenance are ongoing. In such cases, the wife is not a third party, and income information is essential for claiming rightful maintenance. Without pending legal disputes like maintenance claims, requests are typically denied to protect employee privacy,” said Alay Razvi, Managing Partner, Accord Juris.

Can a wife seek income details from tax filing?

A wife cannot seek access to her husband’s income-tax returns under the RTI Act unless the request is connected to a matrimonial proceedings such as a maintenance or alimony claim. “The details disclosed by a person in his income tax returns are 'personal information' which stands exempted from disclosure,” Shashank Agarwal, Founder, Legum Solis, said.

What are the different cases and rulings around a husband's salary slip?

Supriya Majumdar, Partner, Elarra Law Offices, shared various judgments that have examined the issue of husband’s salary slips and the conditions under which the information can be shared.

The Supreme Court has emphasised the requirement of filing a comprehensive affidavit for disclosing the assets, income, expenditure and liabilities in matrimonial disputes involving a claim for maintenance.

The top court has held that the information regarding service, career, assets and liabilities can't be sought under the RTI Act, as they qualify as personal information under Section 8(1)(j) of the RTI Act and when such information is not required for bona fide public interest, granting such information would cause invasion of privacy.

The Madhya Pradesh High Court has, however, held that while dealing with Section 8(1)(j), it cannot lose sight of the fact that the parties to the proceedings were spouses and as such, the wife was entitled to know the remuneration of the husband. Citing the MP High Court order, the Madras High Court has upheld the right of the wife to seek information regarding service details of the husband under the RTI Act for the purpose of adjudication of the quantum of maintenance.

A husband’s salary details cannot ordinarily be accessed as they are personal information. However, in matrimonial or maintenance proceedings, courts may direct disclosure, recognising that accurate income details are vital to ensure fair and just financial support.
