The case came up for hearing today before a division bench of the Delhi High Court led by Justice Yashwant Varma.
The case is likely to come up for hearing on August 24. The court has also asked SpiceJet's Chairman and Managing Director Ajay Singh to be personally present in the court.
The court also rejected Maran's challenge to the arbitral award. Maran had requested to invalidate the portion of the award that included the interest on the amount of Rs 270 crore for the non-issuance of compulsory redeemable preference shares.
The order was passed in an application by Kalanithi Maran, the chairman of Sun Group alleging that SpiceJet has not filed an affidavit of assets and liabilites as per the court's orders.
The court pulled up SpiceJet for filing the application and noted that SpiceJet was pursuing a luxury litigation and said it will not grant any extension to SpiceJet as commercial morale must be upheld.
