In a big setback to Rajesh and Nupur Talwar, the Supreme Court on Thursday dismissed their review petition to quash the ongoing trial proceedings against them in the Ghaziabad court, in the Aarushi-Hemraj double murder case, saying it did not find any merit in the petition. Automatically, the bail application of Nupur Talwar was also dismissed. This means that Nupur Talwar will remain in Dasna jail as her bail application was termed infructuous by the court.
Senior CBI counsel Rajiv Nanda said, "The bail petition is automatically dismissed when the main petition is dismissed. The High Court has already dismissed their bail application. Talwars will now have to file a fresh bail plea in the Supreme Court challenging the High Court order."
However, the court said that Trial will go on against the Talwars, he said.
Nupur Talwar's lawyer Avinash Kumar said that the option for Talwars to file a fresh bail application before the appropriate court is still there. "The defence will now review the court order and then decide on the future course of action. We will do what is best in the interest of the Talwars," he said.
Former Joint CP, Delhi Police, Maxwell Pereira said, "I am totally with CBI. I wonder who has been giving advice to the Talwars and who is benefiting from this. This was a diversion act of Talwars. CBI has rightly said that this is an attempt to delay the proceedings."
Talwars are facing murder and destruction of evidence charges in the case.
