Special judge Vishal Gogne passed the order on an appeal filed by the AAP leader against an order of a magisterial court, which issued summons to Atishi on the complaint of Praveen Shankar Kapoor.

The court will on July 29 hear a plea seeking regular bail for Kejriwal who was arrested by the CBI on June 26
The case was adjourned on the request of ED as they sought time to file a rejoinder to Kejriwal's response to the plea. Additional Solicitor General (ASG) SV Raju appeared for ED and contended that they were served with Kejriwal's response late last evening and they would like to file a response to the same.

Responding to this, senior advocate Abhishek Manu Singhvi, who appeared for the CM, stated that Kejriwal has chosen to challenge the validity of his arrest rather than pursuing a bail plea
The Representation of People Act, 1951, says that a lawmaker stands disqualified if he/she is convicted for an offence. However, since Kejriwal has not been convicted yet, there is no bar on him continuing as CM.
"We are not inclined to pass such an order at this stage," Delhi HC said. The plea is now likely to come up for hearing on April 22 and the court has directed the ED to file a response.
The court has however not issued notice in the appeal by Kejriwal as it noted that it would like to hear the case at length before passing any order. The case is now likely to come up for hearing on March 11.
