Defending the legal validity of the will, Priya’s counsel said, ‘He (Sunjay Kapur) didn’t provide for the children in the will because he provided for them in the trust.’

Priya Sachdev Kapur, the widow of Sona Comstar head Sunjay Kapor, has reiterated that the will by the late industrialist is genuine and that the allegation of using wrong language is just ‘typo’.

Appearing for Priya, senior advocate Rajiv Nayar countered the allegations levelled by children of Sunjay’s former wife Karisma Kapoor. On Wednesday, Priya Kapur made submissions before Justice Jyoti Singh during the ongoing hearing in the partition case filed by Kiaan and Samaira Kapoor against their step mom in the Delhi High Court.

Nayar, who described the inheritance battle as “wife versus wife.”. He also argued that “obviously the current wife would be preferred over the estranged one.”

Priya’s counsel went on to say that there was no challenge to the will. At the heart of the case is the will dated March 21, 2025, which allegedly leaves Sunjay Kapur’s entire personal estate to Priya Sachdeva Kapur.

"I disclose the Will on July 30. There were two opportunities to plaintiff. There was a Will reading. It was read out to everyone, including plaintiff. Everybody knew that there is a will of Sunjay Kapur in existence. Suit is filed on September 09, there is no reference or challenge to Will in the plaint...Will is shared with them on September 15. I am only on being aware of the Will. I put the entire Will and execution of my written statement. It is filed on October 13. What is important is at any stage the application is filed to substantially challenge the Will. A replication to atleast rebut the written statement… there is no replication," Nayar told the High Court.

On allegations of wrong pronouns were being used in the will to address Sunjay Kapur, Nayar argued, “I am assuming this to be probate proceedings. After 45 years, I am told that there are four additional grounds to invalidate a Will- wrong spelling, wrong address, writing testatrix instead of testator and closeness of witnesses. I ask myself, in the entire experience of your ladyship, both as lawyer and a judge, is this the requirement of proof in a probate case that a Will will be invalidated on any of these grounds? Because Rajiv is spelt as Rajeev and not Rajiv? Will it be invalidated because there is spelling mistake? Forgery has to be complete. No mistakes will be left. And this lady is not a housewife. She is an investment banker.”

Dismissing the children’s contention around the timing of their father’s will’s discovery, Nayar said, “Is the discovery of the will after seven weeks a ground to challenge the will?”

Defending the legal validity of the will, Priya’s counsel said, “He (Sunjay Kapur) didn’t provide for the children in the will because he provided for them in the trust.”

Samaira and Kiaan Raj have challenged the purported will and sought shares in his assets reportedly worth Rs 30,000 crore. Priya Sachdev Kapur, on the other hand, informed the court that they have already received Rs 1,900 crore from the family trust
