No immediate relief for Arvind Kejriwal, SC fixes June 26 for bail hearing plea

In stay applications, orders are not reserved. They are passed on spot. It is a bit unusual. Anyway, we will have it day after tomorrow, says SC bench.

The Supreme Court on Monday adjourned Delhi Chief Minister  Arvind Kejriwal's petition  challenging the stay on his bail. The court posted the matter for  hearing on Wednesday.

The bench headed by Justice Misra, while hearing the bail plea  said, “In stay applications, orders are not reserved. They are passed on spot. It is a bit unusual. Anyway, we will have it day after tomorrow.”

Kejriwal  approached the Supreme Court challenging the order passed by the Delhi High Court on June 21 staying the trial court's order which granted him bail in a money laundering case linked to a now-scrapped excise policy.

The top court told advocate Abhishek Singhvi that if it passes any order on CM Kejriwal's plea against HC’s stay order, it will be prejudging issue.

The Enforcement Directorate (ED) on June 21 had moved the Delhi High Court to challenge the bail granted Kejriwal. According to ANI, the Delhi High Court agreed to take up the ED plea seeking an urgent hearing on its appeal challenging the trial court order granting bail to Kejriwal.

“We have challenged the stay order (Delhi CM Arvind Kejriwal bail) of the High Court in the Supreme Court. The Supreme Court in its hearing observed the order has not been finally pronounced yet so we will have to wait for the High Court’s order,” said advocate Rishikesh Kumar, counsel of Kejriwal.

The AAP national convenor was granted bail on June 20. The Rouse Avenue Court granted bail on a bail bond of Rs 1 lakh. The court had also imposed certain conditions on Kejriwal before granting him the relief -he should not try to hamper the investigation or influence the witnesses. The judge also directed Kejriwal to appear before the court whenever required.
