The materials placed on record indicate that Sunjay Kapur was exploring avenues for Karisma and their two children to secure Portuguese nationality. In one of the cited conversations, Sunjay informed Karisma that she would need to renounce her Indian citizenship, as the country does not permit dual nationality. The details, now before the court, hint at deeper personal involvement between the estranged spouses than was publicly known.
On Wednesday, the Delhi High Court issued notice on the civil suit filed by Karisma Kapoor’s children, who are claiming a share in their father’s estate estimated at Rs 30,000 crore. Justice Jyoti Singh directed summons to be served on the defendants and asked for written statements within two weeks. Replications are to follow within one week thereafter.
The next hearing is scheduled for October 9, when the court will also consider the plea for an interim injunction. Meanwhile, Priya Sachdeva Kapur, Sunjay’s widow, has been directed to file a complete list of all movable and immovable assets of the deceased.
Representing the plaintiffs, Senior Advocate Mahesh Jethmalani alleged that Priya Kapur forged Sunjay’s will to usurp his assets. He described the will as unregistered, hastily read out at the Taj Hotel, and disclosed under suspicious circumstances. According to him, the executor had only learned of the will a day earlier, and the disclosure came from a family employee.
Priya Kapur’s counsel, Senior Advocate Rajiv Nayar, countered that the children had already received assets worth Rs 1,900 crore under a family trust and were beneficiaries of other holdings. “It’s not as if these people are left on the streets. I am a widow with a six-year-old child. For 15 years, they were nowhere to be seen,” he argued. He placed the will before the bench and said he was willing to share it with the plaintiffs, subject to a non-disclosure agreement.
Adding to the discord, Sunjay’s mother, Rani Kapur, voiced her concerns through her counsel. She told the court she had repeatedly sought a copy of the will but never received one. “There’s something unholy going on. I am 80 years old and concerned about my grandchildren. A trust set up by me has nothing for me?” she asked.
As the legal battle deepens, the revelation of Sunjay’s efforts to secure foreign citizenship for Karisma and their children adds a complex new layer to the already high-stakes inheritance fight.
