The family of Charu Khandal, a character animator working for Shah Rukh Khan's Red Chillies Entertainment, who tragically died in 2017 after sustaining life-altering spinal injuries in a traffic accident five years earlier, has recently had a Rs 62 lakh settlement upheld by the Bombay High Court.

Given the severe loss Khandal's family has suffered, the decision to maintain the compensation that was first awarded by the Motor Accidents Claim Tribunal has been praised as a fair and just outcome.

As per Live Law, the compensation given to the family of Charu Khandal, a character animator working for Red Chillies Entertainment, was confirmed by a bench made up of Justices Girish Kulkarni and Advait Sethna.

After being in a terrible car accident in 2012 that left her paralysed from the neck down, Charu Khandal's life took a terrible turn. Charu's health declined over time despite receiving extensive medical care, and she passed away from her wounds in 2017 at the young age of 28.

Khandal was well-known for her commitment and talent as a character animator. Her sudden passing caused a gap in the animation field and had a significant impact on her family and coworkers.

After examining the case's facts and circumstances, the Bombay High Court determined that the ₹62 lakh sum was fair and reasonable. The court's decision recognised Khandal's family's sorrow and suffering, especially in light of the life sentence of paralysis she had to serve prior to her tragic passing.

"Perfect compensation is hardly possible, but fair compensation ought to be the norm. Each case has to be decided in light of its own facts and at the end, one must ask whether the sum awarded is a fair and reasonable sum. Adverting to these principles, we are of the view that in the given facts and circumstances, the least that can be done to serve the ends of justice is to uphold the grant of compensation of Rs.62,20,000/- to the family of the deceased who did not deserve the life that she went through after the accident leading to the final sacrifice of her life, as fate/destiny would want it to be," the bench mentioned.
