US President Donald Trump and Russian President Vladimir Putin may meet next week, according to Moscow's deputy UN ambassador. This comes as Putin faces an arrest warrant from the International Criminal Court (ICC) since the start of the Ukraine war.

Yuri Ushakov, an adviser to President Vladimir Putin, suggested that the United Arab Emirates was considered one of the “most suitable” venues for a potential summit. However, the White House dismissed Russia's claims, stating that no meeting between them had been finalized, nor had any location been confirmed.

Opting for the UAE as the host nation would allow Putin to travel to a country that is not a member of the International Criminal Court (ICC), thereby reducing the risk of arrest.

Despite the ICC’s warrant for “war crimes” related to the abduction of children from Ukraine following Russia’s invasion, Putin has not entirely avoided international travel. Since the warrant’s issuance, he has visited several countries, including Mongolia, an ICC member, as well as China and North Korea, neither of which is a party to the court.

While the threat of arrest remains in ICC member states, Putin appears to be carefully navigating international venues to maintain his diplomatic presence.

ICC's global reach, but limited power

The International Criminal Court is based in the Netherlands, which was established in 2002 to hold politicians accountable for crimes against humanity, war crimes, and genocide.

Over 100 countries are members of the ICC, with Ukraine being the most recent to join.

The court employs over 900 personnel and operates on a $228 million budget. Its main limitation is its lack of enforcement power; it relies on member states to carry out arrest warrants. Yet, compliance has often been inconsistent.

This limitation is highlighted by the fact that Putin has traveled to Mongolia, an ICC member, despite an active warrant. He has also visited China and North Korea, both of which an ICC members.

The ICC has issued over 60 arrest warrants, but 30 individuals remain at large. In many cases, the court represents a last resort for justice.

Essentially, it targets individuals that other nations either cannot or will not prosecute. Both the United States and Russia have expressed opposition to the ICC.

Putin is wanted, along with some other members of the Kremlin, for his alleged involvement in the abduction of children from Ukraine.

Global Non-compliance Challenges

Mongolia is not alone in failing to enforce an ICC warrant. Hungary similarly did not comply during a visit by Netanyahu; instead, Prime Minister Viktor Orbán, who is close to Putin, welcomed him warmly. Orbán has also announced that Hungary will leave the ICC.

Other former members include Burundi and the Philippines. The Philippines’ ex-president, Rodrigo Duterte, is currently in the ICC’s custody block in The Hague, having been arrested on charges of crimes against humanity tied to his brutal drug crackdown.

Duterte was detained in March upon arrival from Hong Kong, and President Ferdinand Marcos described the arrest as “proper and correct” and not politically motivated.

Another notable example of non-compliance occurred in South Africa, which allowed Sudan’s then-leader Omar al‑Bashir to visit in 2015 without arrest, despite his status as a fugitive wanted for genocide in Darfur.

Al‑Bashir remains imprisoned in Sudan but has not been transferred to The Hague, even after being ousted in a 2019 popular uprising.
