On April 16, 2025, the United Kingdom's Supreme Court delivered a landmark ruling, unanimously determining that the terms "woman" and "sex" in the Equality Act 2010 refer strictly to biological sex. This decision excludes transgender women, including those holding Gender Recognition Certificates (GRCs), from the legal definition of "woman" under the Act.

The case originated from a challenge by the advocacy group For Women Scotland against Scottish government guidance that included trans women with GRCs in the definition of "woman" for public board representation. The Supreme Court ruled that such inclusion would render the Equality Act "incoherent," emphasizing that sex-based rights and protections are intended for biologically defined groups.

Conversely, LGBTQ+ advocacy groups, including Stonewall and Scottish Trans, have expressed concern over the potential implications for transgender individuals' rights and access to services. ​

Amnesty International criticised the decision, arguing that excluding transgender women from sex discrimination protections conflicts with human rights laws. The organisation stated that "a blanket policy of barring trans women from single-sex services is not a proportionate means to achieve a legitimate aim."

The Supreme Court clarified that while the ruling defines "woman" and "sex" based on biological criteria, transgender individuals remain protected under the Equality Act's provisions against discrimination based on gender reassignment. The practical implications of this decision will depend on how it is implemented and interpreted in various contexts, including access to single-sex services and participation in gender-specific programs.
