Nishikant Dubey on Saturday sparked controversy after he commented on Supreme Court

Amid the political row surrounding BJP MP Nishikant Dubey’s remarks on judiciary, Assam Chief Minister Himanta Biswa Sarma said that the party has not endorsed his colleague’s remarks.

In a post on X, Sarma said the BJP has consistently upheld the independence and dignity of the judiciary as a cornerstone of India’s democracy. He also listed how the Congress attacked the judiciary and judges and listed several such instances.

“Recently, Hon’ble BJP President Shri @JPNaddaji reaffirmed this commitment by distancing the party from remarks made by Hon’ble MP Shri @nishikant_dubey ji concerning the Supreme Court. Adarniya Nadda Ji emphasized that these were personal opinions and not reflective of the party’s stance, reiterating the BJP’s deep respect for judicial institutions,” Sarma said on X.

Sarma said that while the BJP maintains this principled position, it is pertinent to examine the Congress’ historical interactions with the judiciary. “The Congress has, on multiple occasions, publicly criticized esteemed members of the judiciary. Justice Dipak Misra: Faced an unprecedented impeachment motion initiated by Congress and other opposition parties, alleging misconduct without substantial evidence. - Justice Ranjan Gogoi: Subjected to severe criticism following landmark judgments, including the Ayodhya verdict. - Justice Arun Mishra: Targeted for his judicial decisions and alleged proximity to the executive, despite his adherence to constitutional duties. -Justice D.Y. Chandrachud: Faced undue scrutiny over his interpretations in significant cases, reflecting a pattern of disapproval when verdicts didn’t align with certain political expectations. - Justice S. Abdul Nazeer: Criticized by the Congress for his appointment as the Governor of Andhra Pradesh shortly after retirement, alleging it threatened judicial independence, despite similar appointments in the past,” the Assam said.

According to Sarma, the pattern suggested a tendency within the Congress to challenge the judiciary’s credibility when decisions are unfavorable to their political narrative. “Such selective criticism not only undermines the sanctity of judicial processes but also sets a concerning precedent for democratic discourse,” he said.

The Assam CM said while the BJP continues to honour the judiciary’s role impartially, it’s crucial for opposition parties to reflect on their approach, ensuring that critiques are rooted in principle rather than expediency.

Dubey on Saturday sparked controversy after he remarked that if the Supreme Court wants to make laws, then there is no need for Parliament in the country.

In a post on X and later in comments to news agencies, Dubey said, "If the Supreme Court has to make laws, then Parliament should be shut down."

His remarks came amid the ongoing hearing in the Supreme Court over the recently-enacted Waqt (Amendment) Act, 2025.
