The high-stakes legal tussle over late businessman Sunjay Kapur’s Rs 3,000-crore estate took a dramatic turn on Monday as the Delhi High Court resumed hearing a plea filed by Samaira (20) and Kiaan (15) — his children from actor Karishma Kapoor. Represented by senior advocate Mahesh Jethmalani, the siblings have alleged that the will produced by Kapur’s second wife, Priya Sachdev Kapur, was forged to disinherit them.
“There is something very secretive about this will,” Jethmalani told the court, arguing that the document contained errors in the children’s names and addresses, which he described as “highly uncharacteristic of Sunjay Kapur.” He added, “Sunjay was in good health, and his properties were secured under a tight trust. The circumstances surrounding this will raise serious doubts.”
The contentious document, dated March 21, allegedly leaves Sunjay’s entire personal estate to Priya Kapur. Jethmalani questioned multiple modifications to the digital file, made on March 17 and March 24, calling it an “ominously uncertified document.” In response, Priya Kapur’s counsel said the date changes appeared because “the file was being uploaded,” insisting all versions were identical.
Jethmalani, however, countered that “two wills seem to exist,” and accused Priya and a co-conspirator, Dinesh Agarwal, of manipulating the document through a secret WhatsApp group, where messages about the will were allegedly exchanged and acknowledged by Priya, not Sunjay.
The case revolves around a plea to maintain status quo on executing the will, which Priya Sachdev claims is genuine. Samaira and Kiaan contend that following Sunjay’s death in the UK in June, Priya “usurped full control” of his assets through the fabricated will.
The courtroom drama follows last week’s heated exchanges, when Jethmalani likened Priya to “Cinderella’s stepmother” and accused her of greed, claiming she received 60% of the assets, allocated 12% to her son, and controlled 75% of the trust.
Adding to the dispute, Sunjay’s mother, Rani Kapur, has also challenged the will, stating that “nothing has been left for me.” The case will continue as the court examines the authenticity of the will and the allegations of manipulation surrounding it.
