Aam Aadmi Party MLA Naresh Balyan was arrested under the stringent Maharashtra Control of Organised Crime Act (MCOCA) on December 4 shortly after getting bail in the 2023 extortion case. During the hearing of Uttam Nagar MLA’s bail plea in the extortion case, the Delhi Police said it would arrest the ruling party lawmaker in a MCOCA case. On behalf of Delhi Police, Special Public Prosecutor Akhand Pratap Singh submitted the plea before the Rouse Avenue Court on Wednesday.

Before the hearing at the Rouse Avenue Court, Delhi Police had moved a plea in Dwarka Court and sought permission to quiz Balyan in the MCOCA case. In the application submitted to Additional Sessions Judge Vandana Jain, the Special Public Prosecutor said Balyan’s immediate questioning was necessary due to the startling statements given by the witnesses. The court had allowed the police to go ahead with the interrogation while Balyan was still in custody.
By the time the Rouse Avenue Court took up the bail plea of Balyan, the Delhi Police told the court that they will be arresting the Uttam Nagar MLA as he had not cooperated in the questioning for the MCOCA case. Balyan was first arrested by Delhi Police on November 30 last month after the BJP alleged that he had links with gangster Kapil Sangwan. To prove their allegations, the party had released an audio clip that had a purported conversation between AAP MLA and the gangster.
