Supreme Court issues notice to builder in Gurugram’s Chintels Paradiso case as homebuyers file contempt plea

The homebuyers have accused the developer of failing to commence reconstruction of the damaged towers as directed by the court and of halting rent payments to displaced residents, in violation of both judicial and administrative orders.

The Supreme Court of India has issued notice to Chintels India Pvt. Ltd. after a group of 12 flat owners from Chintels Paradiso housing society in Gurugram, filed a Contempt Petition alleging “willful non-compliance” of the apex court’s reconstruction and rent payment orders and other subsequent administrative directions issued by the Divisional Commissioner and Deputy Commissioner of Gurugram.

The homebuyers have accused the developer of failing to commence reconstruction of the damaged towers as directed by the court and of halting rent payments to displaced residents, in violation of both judicial and administrative orders.

The residential complex by Chintels India Private Ltd in Sector-109 near Dwarka Expressway earned national attention after a portion of Tower D collapsed in February 2022, killing two women and injuring others. Subsequent structural audits of the housing complex had declared all nine towers of the society as “unsafe to live” and recommended to demolish these towers.

Rakesh Hooda, President Chintels Paradiso Resident Welfare Association (RWA) said that the Supreme Court said in its January 2024 ruling that “the builder must pay suitable rent to affected buyers from the commencement of re-construction until the project gets completed”, but the developer is not complying with these orders.

“The developer has stopped paying rent to displaced flat owners of the Chintels Paradiso housing complex. The builder is also not starting the reconstruction of flats. Both these actions are in contempt of the Supreme Court order issued in January 2024. We have filed a contempt petition in the apex court, and its hearing was conducted on November 10 where after hearing us the court issued notice to the developer to respond to the charges of defiance,” Hooda told Moneycontrol.

The next hearing of the matter is scheduled for February 2026.

Hooda also said that this contempt petition is not just about rent or reconstruction — it’s also about restoring faith in the justice system and ensuring that no homebuyer is left helpless after years of suffering.

The demolition of unsafe towers began in March 2024 after expert evaluations and constant pressure from displaced residents for action.

Homebuyers of the society said that the contempt petition highlights persistent issues such as the delay in executing the Supreme Court’s orders, lack of clarity on compensation or reconstruction, and the plight of flat owners caught between collapsed buildings and stalled processes.

Responding to Moneycontrol queries, Chintels Spokesperson said, "We have compiled with all the Supreme Court’s directive, wherein we have been directed to pay rent upon commencement of construction. We are fully committed to complying with all directives; however, a group of residents continues to stall the process of reconstruction as they refuse to vacate.”
