Gurugram real estate regulator penalizes developer for publishing misleading advertisement

Gurugram RERA fines developer with Rs 25 lakh for publishing misleading advertisement

The Real Estate Regulatory Authority (RERA), Gurugram, has imposed a penalty of Rs 25 lakh on Yashvi Homes Pvt Ltd for publishing a “misleading advertisement” of a real estate project under the state government scheme - Deen Dayal Jan Awas Yojana (DDJAY) 2016 - in a mainstream daily, the Authority noted.

The RERA Gurugram took a suo motu action in the matter, terming the advertisement "completely misleading". Yashvi Homes is developing the residential project Golden Gate Residency at Sector 3, Farukhnagar in Gurugram, under the DDJAY scheme.

The Authority noted that the policy is known as Deen Dayal Awas Yojana (DDJAY) 2016 while the advertisement published in the newspaper has captioned it as DDJAY 2024, which is “incorrect and misleading”.

The promoter has not clearly mentioned the details of registration number of the project and the website address of the Authority, as required under the regulations, the Authority said in a statement.

There was no response from the promoter to queries sent by Moneycontrol seeking a comment.

As per the provisions of Section 11(2) of the RERA Act 2016 the advertisement or prospectus issued or published by the promoter shall mention prominently the website address of the Authority, wherein all details of the registered project should be entered correctly and it should also include the RERA registration number.

“While there is no provision for amenities like school, club house, swimming pool, badminton court, half basketball court among others in the approved layout plan submitted by the promoter at the time of registration, the same has been mentioned in the advertisement,” said the spokesperson of the Authority, adding that the amenities promised in the advertisement are not as per the sanctioned layout plan of the project.

The spokesperson said that the Authority has warned real estate promoters to avoid “misleading advertisements” or else face action.
