For high-net-worth individuals considering U.S residency, traditional immigration routes can be slow and complex. Established programs like the EB-5 visa often involve long waiting periods, project-specific risks, and extensive documentation.
The Trump Gold Card has emerged as an alternative, offering a faster pathway for those willing to make a significant investment. While it promises speed and a streamlined process, experts note questions around cost and long-term viability.
“Trump’s executive order established a direct path to permanent residency for ultra-wealthy investors, offering a $1 million ‘golden visa’ that provides the fastest route to permanent residency in the world,” explains Keshav Singhania, Head – Private Client, Singhania & Co.
Unlike the EB-5 visa program, which often takes years due to project approvals and backlogs, the Gold Card guarantees green cards within six to nine months, eliminating the long wait and uncertainty that comes with EB-5, explained Singhania.
"Unlike EB-5, which involves an investment of $800,000, this is a fee. So, there is no return of capital or potential to earn revenue on this amount," said Poorvi Chothani, founder and managing partner of LawQuest, an immigration and employment law firm in Mumbai, India.
How does the EB-5 visa work?
Among the clearest routes to US permanent residency, EB-5 enables a non-US person to secure a Green Card through investment. The EB-5 Immigrant Investor Program, in place since 1990, allows a non-US investor applicant and their immediate family members to gain US permanent residency status and receive a Green Card. Through this programme, the qualified applicant invests between $800,000 and $1.05 million into projects, via regional centres within the US, and the investment must lead to the creation of more than 10 American jobs.
“So, the EB-5 program, which has been around for many years, had an investment of a million dollars into projects in America. And those projects were often suspect, they didn’t really work out, there wasn’t any oversight of it. So, it was poorly overseen, poorly executed. Then you had our border open, where millions of people came through. So, the idea is we will have a proper business. We will modify the EB-5 agreement,” US Secretary of Commerce Howard Lutnick said earlier.
The Trump Gold card
The Gold Card is designed for individuals who make a $1 million contribution to the U.S. Treasury. After background checks and approvals from Homeland Security, successful applicants receive permanent resident status under the EB-1 or EB-2 visa category.
"The modalities of obtaining the gold card are yet to be released. This is supposed to be an offer to gain stability for people who are stuck in the EB-2 and EB-3 visa queues. However, the announcement talks about the $1,000,000 fee and indicates that a visa has to be available. So it is not clear how this offers stability as visa numbers cannot be unilaterally increased," said Chothani.
By contrast, the Gold Card program operates much like a traditional green card model but with a distinct high-net-worth focus. Investors are required to pay global taxes comparable to U.S. citizens or permanent residents. "We anticipate THE TRUMP GOLD CARD will generate well over $100 Billion Dollars very quickly. This money will be used for reducing Taxes, Pro Growth Projects, and paying down our Debt," posted Donald Trump in a Truth social post.
There are, however, potential risks associated with the Gold Card. "It is likely that the Gold Card program will face legal challenges, as allowing individuals to bypass existing visa programs could potentially lead to lawsuits. Additionally, it’s worth noting that the official website states that the Trump Gold Card status acts as a visa and may be revoked due to national security and other risks," said Singhania.
U.S. permanent residency can also be obtained through several traditional avenues, including family sponsorship, employment-based visas, refugee or asylum status, the diversity visa lottery, or humanitarian programs. Each route has its own eligibility requirements and typically involves background checks, medical screenings, and interviews before lawful permanent resident status is granted.
In essence, the choice between EB-5 and the Trump Gold Card comes down to speed, cost, and risk tolerance. EB-5 offers a structured path but with longer timelines and project dependence. The Gold Card provides ultra-wealthy investors a faster, more flexible route.
Each route comes with its own set of eligibility criteria, often requiring sponsorship, proof of qualifications, or evidence of persecution in the case of asylum. All applicants must undergo rigorous background checks, medical screenings, and, in most cases, a formal interview before being granted lawful permanent resident status, said Singhania.
For investors, the key is understanding the nuances of each program, assessing risk, and seeking professional guidance to determine which path aligns with their financial goals and immigration plans.
