Nora Fatehi faces legal trouble as lawyers write to MHA over her work permit in India, allege ‘Misuse of stay privilege’

A controversy has erupted around Nora Fatehi following objections raised against her latest track Sarke Chunar Teri Sarke, which has drawn criticism from a group of lawyers.

A fresh controversy has erupted around Nora Fatehi after a group of ten lawyers wrote to the Ministry of Home Affairs, demanding that her work permit be cancelled and that she be deported from India over her latest song Sarke Chunar Teri Sarke.

As reported by The Print, the letter, sent on Thursday, wasn’t limited to just one authority. It was also addressed to the Ministry of Information and Broadcasting, the Central Board of Film Certification, the Ministry of Electronics and Information Technology, and the National Commission for Women—showing the seriousness with which the issue is being raised.

At the heart of the complaint is the claim that the content of the song crosses a line. “It is respectfully submitted that Ms. Nora Fatehi has been consistently misusing the privilege of her stay in India by actively participating in, promoting, and disseminating content that is obscene, vulgar, sexually suggestive, and deeply offensive to public morality, the dignity of women, and the sensibilities of Indian society, including children and young persons,” reads the letter.

The lawyers have pointed to legal provisions under the Foreigners Act, 1946, arguing that the government has the authority to take action against foreign nationals if their conduct is seen as harmful to public decency or order.

They have also cited other laws, including the Passport (Entry into India) Act, 1920, to strengthen their case.

The controversy stems from the song Sarke Chunar Teri Sarke from KD: The Devil, featuring Sanjay Dutt and Nora Fatehi. Ever since its release on YouTube on 14 March, the track has been under scrutiny for its lyrics, written by Raqueeb Alam. Lines such as “Pehle uthale, andar wo daale (First he lifts and puts it in)” have been criticised for their double meaning and suggestive tone.

“Further, the Song also violates the provisions of Sections 294, 296, and 79 of the BNS and Section 4 of the Indecent Representation of Women (Prohibition) Act, 1986. The publication and release of the Song in public domain constitutes an offence punishable under Section 67 of The Information Technology Act, 2000,” reads the letter.

The lawyers have also raised broader concerns, claiming that such content promotes obscenity, objectifies women, and normalises problematic narratives.

Amid the backlash, Nora Fatehi addressed the issue in an Instagram video, explaining that she had originally recorded a Kannada version of the song three years ago, and that the Hindi version was created later without her involvement.

However, the lawyers have dismissed this explanation, calling it a ‘self-serving afterthought’.

“An accused cannot simultaneously claim the benefits of a performance (remuneration, fame, and public visibility) while disclaiming all responsibility for its content. Second, the fact that the lyrics may have been generated by an Artificial Intelligence tool does not extinguish criminal liability; the law fastens liability upon the human beings who commission, approve, adopt, perform, produce, and disseminate such content, regardless of the instrument or tool used in its creation,” reads the letter.

For now, no official action has been announced, but the situation has sparked a wider debate.
