The Delhi High Court on Wednesday stepped into the family dispute surrounding the estate of late industrialist Sunjay Kapur. The court issued notice on a plea filed by Sunjay’s two children – Samaira and Kiaan with actor Karisma Kapoor, who are seeking a share in their father’s Rs 30,000 crore assets.

Justice Jyoti Singh directed Priya Kapur, Sunjay’s third wife and the main defendant in the case, to submit a complete list of all movable and immovable assets as of June 12, the date of his passing.

“Issue notice. Reply in two weeks, rejoinder in a week thereafter. Along with replies, Defendant 1 will file a list of all movable and immovable assets known to Defendant 1,” the order stated.

The matter will now be heard on October 9, when the court will consider the children’s plea for an interim injunction.

The judge also pressed Priya Kapur to explain her reluctance to provide a copy of Sunjay Kapur’s will to the children.

“I don’t know why you should not part with the copy of the will to the children. Of course there can be a non-disclosure agreement. We can constitute a confidentiality club as well. We do this in intellectual property matters routinely,” Justice Singh remarked.

Priya Kapur’s counsel, however, told the Court that the children had already received Rs 1,900 cr.

However, sources say that the control of these assets remain with Priya Kapur in the RK family trust and that the children have no access to this.

The dispute stems from a will dated March 21, 2025, which allegedly bequeaths Sunjay Kapur’s entire estate to Priya Kapur.

Karisma’s children have challenged the will, calling it forged and fabricated, and alleging it was deliberately suppressed for weeks before being revealed at a family meeting on July 30.

They further claim Priya Kapur conspired with associates Dinesh Agarwal and Nitin Sharma in orchestrating the fraud.

Karisma Kapoor and Sunjay Kapur were married for 13 years before their divorce in 2016. The couple has a son and a daughter, who now argue that they have been wrongfully excluded from their father’s estate despite being Class I legal heirs under succession law.

The suit names Priya Kapur, her minor son, and executor Shradha Suri Marwah as defendants. The children have sought partition of the estate, asking for a one-fifth share each, and requested the freezing of all personal assets of Sunjay Kapur until the matter is resolved.

Sunjay's mother, Rani Kapur, meanwhile, also challenged the will, saying there was nothing left to her, terming the entire process "unholy".

"Today, I have nothing. I have written at least 15 emails asking about the will, what are the documents? Not a word has been shared. I have been told that my emails have been compromised. There is something incredibly unholy. Rs 10,000 crore worth of assets should have been mine. I am 80-year-old. Mother, her vested interest goes into trust. All gone. I am nowhere. Ms Sachdeva (Priya) comes in, within three months of her getting married, everything goes? My son today leaves me with not a roof on my head," her counsel asked.

The plaint has claimed neither Sunjay mentioned about the will, nor Priya or any other person, ever mentioned about its existence.

It alleges the conduct of Priya demonstrates, "without a doubt, that the alleged will has been fabricated" by her. (With PTI Inputs)
