SC junks Bhushan Power lenders' plea seeking share in company's EBITDA

A two-member bench headed by Chairman Justice S J Mukhopadhaya, said that JSW Stwel will be immuned from the acts done by the former promoters of the Bhushan Power & Steel Ltd.

Passing an order on August 6 order, the NCLAT had allowed all three contenders -- Tata Steel, Liberty House and JSW - to file additional unconditional 'resolution plans' by August 13, 2018.
Tata Steel, a BPSL bidder said to be leading the race, had yesterday moved the plea challenging the NCLT (National Company Law Tribunal) ruling allowing the Committee of Creditors (CoC) to consider the resolution plan submitted by Liberty House.
Bhushan Power and Steel, which owes about Rs 45,000 crore to lenders, is among the 12 non-performing accounts referred by RBI for NCLT proceedings.
The tribunal, which has also jurisdiction in the matters related to insolvency and bankruptcy code, was hearing two petitions filed by lead lenders SBI and PNB.
