Spreading radical ideology on social media attracts UAPA, says Delhi High Court

The Court noted that circulating extremist content digitally is sufficient ground for legal action under UAPA.

A division bench of Justices Subramonium Prasad and Harish Vaidyanathan Shankar clarified that Section 18 of the UAPA covers not just physical acts but also virtual actions that incite or facilitate a terrorist act

The Delhi High Court has said that spreading radical ideology online on digital platforms including through social media, can lead to prosecution under the Unlawful Activities (Prevention) Act (UAPA).

A division bench of Justices Subramonium Prasad and Harish Vaidyanathan Shankar clarified that Section 18 of the UAPA covers not just physical acts but also virtual actions that incite or facilitate a terrorist act.

The Court noted that circulating extremist content digitally is sufficient ground for legal action under this law.

The ruling came while the Court was hearing a plea filed by Arsalan Feroze Ahenger, an alleged overground worker of Lashkar-e-Taiba (LeT) and The Resistance Front (TRF), challenging the trial court's September 2024 order denying him bail.
