Referring to a document which detailed the areas where company had succeeded in getting spectrum, Rohatgi argued that everywhere the company had obtained seniority due to its applications on March 2, 2007 much before others had applied and there was no question of Swan telecom getting involved into changing of the cut-off dates.
Rohatgi further argued that the company had obtained the Letter of Intent (LoI) in January 2008 and the licence was issued to it in March 2008. He pointed out that erstwhile Solicitor General G E Vahanwati and also the Department of Telecom had examined the issuance of licence to the firm in March 2009.
Rohatgi concluded his agreement for bail to his client saying that Goenka was neither involved in a heinous crime like murder nor was a terrorist for which the punishment is life imprisonment or death that he has to be kept in jail.
In the present case, the bail is must for him, said Rohatgi alluding to maximum punishment of seven years jail term in the case against him.
After hearing the arguments for bail to Goenka, Justice Bharihoke slated Monday for hearing CBI arguments against the plea on a request by CBI counsel Sonia Mathur, who said Special Public Prosecutor U U Lalit was busy in the Patial House court to deal with maiden appearance of DMK MP Kanimozhi there in connection with the scam.
