The supreme court today rejected the bail plea of DMK MP, Kanimozhi, and Kalaignar TV managing director, Sharad Kumar. The court directed the duo to approach the trial court for regular bail after the court frames charges against them in the 2G Scam. Hitesh Jain of ALMT Legal, joins CNBC-TV18 to provide clarity on the implications of the move.


The court feels that there is a tendency to delay the trail in the 2G scam by making applications (for bail). Considering this, the court has given liberty to the accused to approach for further application, only after charges are framed, he clarified. Below is the verbatim transcript. Also watch the accompanying video. Q: First of all, what do you make of this?
A: The first thing the court has made sure is that that Kanimozhi and Sharad Kumar will have to spend sometime in the jail. Basically, they will have to make sure that all the procedural formalities are completed expeditiously. The stage is set for framing of the charges. The court feels that there is a tendency on their (the accused) part to delay the trail by making applications (for bail). Now, to make sure there are no procedural delays and the accused cooperate in getting the trail started is a task at hand. The courts have considered this aspect in the bail application and have given the liberty to the accused to apply for the bail at the time after framing of charges. So after this judgment do you think the others might refrain?
A: According to me, it has sealed the fate of other applicants also. On the grounds of parity, the same order is going to apply. I don
