Supreme Court on July 4 declined to hear HDFC Bank’s Chief Executive Officer and Managing Director Sashidhar Jagdishan petition against the FIR filed by the Lilavati Medical Trust, according to a LiveLaw report.
The report added that a bench of Justices PS Narasimha and R Mahadevan observed that it was improper on the part of the Supreme Court to intervene when Jagdishan's petition is listed before the Bombay High Court on July 14. The HDFC Bank CEO approached the Supreme Court, saying that three Bombay High Court judges recused from hearing the matter, causing a delay in the hearing.
On July 3, HDFC Bank’s CEO had approached the Supreme Court seeking to quash the FIR registered by Lilavati Medical Trust.
This comes after three judges in Bombay High Court recused from hearing the matter.
The LiveLaw report added that Senior Advocate Dr Abhishek Manu Singhvi, appearing for the Lilavati Trust, objected to the petitioner approaching the Supreme Court, saying that the matter is listed before the High Court on July 14 with the consent of the petitioner himself.
Senior Advocate Mukul Rohatgi, appearing for the petitioner, pressed for interim protection at least till July 14. He argued that the FIR was frivolous and that the Bank has been roped into a private dispute between the trustees. "Their only intention is to get the MD to the police station," Rohatgi argued, report added.
HDFC Bank had earlier refuted charges saying the bank and its senior officials are being targeted by unscrupulous persons who are abusing the legal process to thwart the recovery of the long outstanding loan due to the bank from recalcitrant defaulters i.e Splendour Gems Ltd (formerly known as Beautiful Diamonds Ltd).
The bank had said it was concerned about its stakeholders and is on the verge of taking strong legal actions as per expert advice, against those who are initiating these baseless allegations with malafide and ulterior motives or involved in propagating the same.
