CNBC-TV18's Sanjay Suri explains how deportation of an individual, in this case business tycoon Vijay Mallya, can take place.
Q: Mallya is in United Kingdom (UK), you have been bringing us details on his prospective whereabouts as well. What will transpire if Mallya was to be deported from the UK?
A: Well, there are certain steps that will have to be taken leading up to that possibility. Communication, of course, will have to be made from India to the British government.
The Indian government agencies cannot act in Britain directly and following that, the government in Britain is going to do two things: One is it will have to serve the order on him that is to say its agencies and the Home Office will have to trace him and serve the notice about revocation of his passport and implication it has for his stay.
Second, it will convey this request from India to the prosecutor's office here in Britain and they will examine the legal basis of the Indian government request to see if it has a firm basis within British law for them to proceed.
If they then recommend that yes we need to proceed, then the prosecutor will ask the government to carry out the deportation. Now if the government accepts their proposal then Mallya still has recourse to the Courts, first to the Magistrates' Court and then there is an Appeals Courts and through the Court process what you will have is an argument on the merits of the case.
Every single detail of the case presented by India will be put under the magnifying lens by very expert lawyers and so this is going to be a lengthy prolonged argument on the merits of the Indian case against Mallya.
