Amid the postponement of H-1B visa interviews in India, several H-1B and H-4 visa holders in the United States have reported receiving emails from US consulates informing them that their visas had been “prudentially revoked.”
The development comes as the US expands social media screening for visa applicants, a process that was earlier applied to international students.
What is prudentially revoked?
A prudential visa revocation is a temporary and precautionary step, not a permanent cancellation. While it does not affect an individual’s lawful stay in the US if they are already present in the country, it requires the matter to be reviewed at the applicant’s next visa appointment.
Immigration attorney Emily Neumann said such notices are being sent to individuals who had past interactions with law enforcement, even in cases where there was no conviction.
"Many of these incidents were already disclosed and cleared in earlier visa stamps. A revocation does not affect lawful stay in the United States, but it means the issue will be re-examined at the next visa appointment," Neumann said in a post on X.
"Hard to see how this is an efficient use of government resources when the incident was already previously vetted," she added.
Neumann also referred to an earlier US State Department statement noting that visa screening is a continuous process. The State Department has since confirmed that social media vetting will now extend to H-1B applicants and their dependents.
According to Reddy Neumann Brown PC, a Houston-based immigration law firm, a prudential visa revocation is issued when potential eligibility concerns arise but have not been conclusively determined. Individuals in the US at the time of revocation may continue to stay lawfully until their status expires. However, if they travel abroad, they cannot re-enter even if the visa stamp remains valid, as it is rendered ineffective.
The revocation notices state that the action takes immediate effect unless the individual is currently in the United States, in which case it becomes effective upon departure.
