A 36-year-old man was shot by his own gun after getting into a violent altercation on a subway train in Brooklyn this Thursday. He is critically injured. The fight that led to the shooting was captured on camera by another commuter.

According to the Brooklyn District Attorney's Office, no charges will be filed against the 32-year-old man who fired the gun as he was acting in self-defence.

The 36-year-old shooting victim was armed with a gun and a knife when he boarded the train on Thursday. He reportedly began to act aggressive towards the 32-year-old, witnesses said, as per ABC News. “I’ll beat you up,” he was heard saying in the video, apparently trying to provoke a fight.
The two engaged in a verbal spat before the 36-year-old began to walk towards the 32-year-old with his gun drawn. The gun led to panic among other commuters, some of whom were filmed crouching on the train floor. “Come on, there are babies here,” one woman was heard pleading with the two men to no avail.

During the physical altercation, the 32-year-old managed to disarm the 36-year-old and fired shots. The 36-year-old was struck in the head, authorities say.

"Yesterday's shooting inside a crowded subway car was shocking and deeply upsetting," Oren Yaniv, a spokesperson for the Brooklyn District Attorney's Office, said in a statement Friday. "The investigation into this tragic incident is ongoing but, at this stage, evidence of self-defense precludes us from filing any criminal charges against the shooter."
